The customer admits having taken knowledge, at the time of the placing of order, the conditions of sale stated here and states to accept them without reserve.
The present general conditions of sale govern the contractual relations between Africafric and its customer, the two parts the acceptor without reserve. These general conditions of sale will prevail on all other conditions appearing in any other document, except preliminary, express and written exemption.
All the placed orders with Africafric are intended has the personal use of the customers, the customers or the product consignees prohibiting any partial or total resale products
Art 2 - Price
Africafric reserves the right to modify its prices constantly, but the products in order will be invoicees on the basis of tariff in force at the time of the recording of the orders (subject to availability).
The products remain the property of Africafric until the complete payment of the price.
The prices of our products are indicated in Euros. The prices indicated on the cards produced are expressed all inclusive of tax and including the VAT for France and the countries of the EEC but the transport charges do not include/understand. At the time of an order by Internet, the total price indicated in the confirmation of order includes/understands the price of the products, the possible packing handling charges of the products, and startup transport charges.
In the event of delivery towards Switzerland, the total amount of the order is expressed net of tax, with load for the customer to pay the taxes specific to Switzerland with reception of its parcel.
In the event of delivery towards a country other than the Metropolitan France, the recipient of the order will be regarded as the importer of the products concerned. For the sendings except European Union, of possible taxes (local, customs VAT or of importation) could be invoiced on arrival of the parcel with destination and will remain with the load of the recipient. These rights and sums will not be spring of Africafric. We advise with the recipient, in case of doubt, to get information about these aspects near the proper local authorities.
Art 3 - Order

The systems of automatic recording communicated by Internet as well as the purchase orders sent by the customer by mail are regarded as being worth proof, of nature, the contents and the date of the order. In the event of order by Internet, Africafric confirms the acceptance of its order to the customer with the address mall that this one will have communicated. Africafric reserves the right to cancel any order of a customer with whom would exist a litigation relating to the payment of a former order.
Art 4 - Availability
In the event of temporary unavailability, Africafric reserves one one week duration additional for the treatment of the order. Art 5 - Paiement
Le réglement des achats pour la France s'effectue par carte bancaire Visa, par chèque ou par mandat postal; pour les autres pays seule la carte bancaire Visa est acceptée.
La carte bancaire ne sera débitée qu'au moment de l'expédition de la commande.

Art 5 - Paiement sécurisé
Notre site fait l'objet d'un des systèmes de sécurisation les plus performants à l'heure actuelle, le procédé universel de cryptage SSL. Le N° de carte bancaire saisi est uniquement connu de PayPAL. Il ne passe pas par le serveur du site.
La commande validée par le client ne sera considérée effective que lorsque les centres de paiement bancaire concernés auront donné leur accord. En cas de refus des dits centres, la commande sera automatiquement annulée et le client prévenu par courrier électronique.

Art 7 - Propriété intellectuelle

A ce titre et conformément aux dispositions du Code de la Propriété Intellectuelle, seule l'utilisation pour un usage privé sous réserve de dispositions différentes voire plus restrictives du code de la propriété intellectuelle. Toute autre utilisation est constitutive de contrefaçon et sanctionnée au titre de la Propriété Intellectuelle sauf autorisation préalable de Africafric.

Les produits proposés sont conformes à la législation française en vigueur. La responsabilité de Africafric ne saurait être engagée en cas de non respect de la législation du pays où les produits sont livrés. Il appartient à l'acheteur de vérifier auprès des autorités locales les possibilités d'importation ou d'utilisation des produits ou services qu'il envisage de commander.
Les photographies et les textes reproduits et illustrant les produits présentés ne sont pas contractuels. En conséquence, la responsabilité de Africafric ne saurait être engagée en cas d'erreur dans l'une de ces photographies ou l'un de ces textes.
Africafric ne saurait être tenue pour responsable de l'inexécution du contrat conclu en cas de rupture de stock ou indisponibilité du produit, de force majeure, de perturbation ou grève totale ou partielle notamment des services postaux et moyens de transport et/ou communications, inondation, incendie. Africafric n'encourra aucune responsabilité pour tous dommages indirects du fait des présentes, perte d'exploitation, perte de profit, perte de chance, dommages ou frais.
Art 9 - Droit applicable des litiges
Les réclamations ou contestations seront toujours reçues avec bienveillance attentive, la bonne foi étant toujours présumée chez celui qui prend la peine d'exposer ses situations. En cas de litige, le client s'adressera par priorité à Africafric pour obtenir une solution amiable.
Le présent contrat est soumis à la loi française.
La langue du présent contrat est la langue française.
En cas de litige les tribunaux de Bordeaux sont seuls compétents.
Africafric ne peut être tenue pour responsable des dommages de toute nature, tant matériels qu'immatériels ou corporels, qui pourraient résulter d'un mauvais fonctionnement ou de la mauvaise utilisation des produits commercialisés. La responsabilité de Africafric sera, en tout état de cause, limitée au montant de la commande et ne saurait être mise en cause pour de simples erreurs ou omissions qui auraient pu subsister malgré toutes les précautions prises dans la présentation des produits. Dans tous les cas, Africafric ne pourra être tenue pour responsable pour non respect des dispositions réglementaires et législatives en vigueur dans le pays de réception, sa responsabilité est systématiquement limitée à la valeur du produit mis en cause, valeur à sa date de vente et ce sans possibilités de recours envers Africafric.
